Georgia Shockingly Plans To Execute Man With Intellectual Disability: U.S. Supreme Court Last Hope to Stop It In Atkins v. Virginia in 2002, the U.S. Supreme Court declared that it is unconstitutional to execute individuals with "mental retardation.' In 2013 the State of Georgia is openly defying this ruling. The State plans to put a man with an intellectually disability to death on Monday, July 15.
